What to do when a hospital official is malfeasant and it effects the care?

This happeneed at the Clinic in Cleveland. Testing was completed for - it took 4 days, and then discharge- a treatment in trial in the US, but widely done in Europe(FDA rules). The Cleveland Clinic was contacted the next month and they said "by the way we need to have you come back here to redo a blow in a tube test". This patient's condition had declined and we couldn't wait the month that the Cleveland Clinic wanted us to. They took us within two days for that four day battery of tests with the understanding that treatment would begin immediately. Now that treatment plans were changed to fit their schedvle, they disregard the patients health needs and didn.t even call but we had to call to find this out- while the situation goes to crisis. Is this malfeasance for the Cleveland Clinic to handle the patient care this way?
